5. User Content

5.1 Ownership

You retain ownership of any content you create, upload, or submit through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your User Content solely for the purpose of providing and improving the Service.

5.2 Content Responsibility

5.3 Content Removal

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Infographic Kit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

7. Payment and Billing

7.1 Subscription Plans

We offer various subscription plans and one-time purchase options. By purchasing a subscription or making a purchase, you agree to pay the fees specified at the time of purchase.

7.2 Billing

Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees associated with your account. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

7.3 Price Changes

We reserve the right to modify our pricing at any time. We will provide notice of any price changes, and such changes will apply to subsequent billing periods.

7.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will continue to have access to paid features until that time.

8. Service Availability

We strive to provide reliable and continuous access to our Service. However, we do not guarantee that the Service will be available at all times or that it will be error-free. We may:

  • Perform scheduled maintenance that may temporarily interrupt service
  • Experience unexpected downtime due to technical issues
  • Modify, suspend, or discontinue any aspect of the Service at any time

We are not liable for any loss or damage resulting from Service unavailability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or results of the Service in terms of accuracy, reliability, or otherwise.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL INFographic Kit, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Infographic Kit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Infographic Kit operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements.
